Als identificeerbaar wordt beschouwd een natuurlijke persoon die direct of indirect kan worden ge\u00efdentificeerd, met name aan de hand van een identificator zoals een naam, identificatienummer, locatiegegevens, een online identificator of van \u00e9\u00e9n of meerdere elementen die kenmerkend zijn voor de fysieke, fysiologische, genetische, psychische, economische, culturele of sociale identiteit van die natuurlijke persoon. Het gaat met andere woorden om alle informatie op basis waarvan een persoon kan worden ge\u00efdentificeerd. Daartoe behoren bijvoorbeeld uw naam, voornaam, geboortedatum, telefoonnummer en e-mailadres, maar ook uw IP-adres.<\/p>\n<p>Het begrip \u2018verwerken\u2019 is heel ruim en dekt onder andere het verzamelen, vastleggen, ordenen, bewaren, actualiseren, wijzigen, opvragen, raadplegen, gebruiken, verspreiden, combineren, archiveren en wissen van gegevens.<\/p>\n<p><strong>Verantwoordelijke voor de verwerking van uw persoonsgegevens<\/strong> (\u201cverwerkingsverantwoordelijke\u201d)<\/p>\n<p>EFC is de verwerkingsverantwoordelijke van uw persoonsgegevens. Dit betekent dat wij het doel en de middelen voor de verwerking van uw persoonsgegevens vaststellen.<\/p>\n<p><strong>Wanneer verzamelen wij uw persoonsgegevens?<\/strong><\/p>\n<p>Wij verzamelen onder meer persoonsgegevens wanneer u:<\/p>\n<ul>\n<li>Onze website bezoekt;<\/li>\n<li>Het contactformulier invult op de website;<\/li>\n<li>Klant of licentiepartner wil worden\/wordt;<\/li>\n<li>Een overeenkomst met ons afsluit;<\/li>\n<li>Onze Kanzi\u00ae appels wenst op te nemen\/opneemt in uw assortiment;<\/li>\n<li>Zich registreert als teler;<\/li>\n<li>Deelneemt aan onze acties;<\/li>\n<li>Onze klantendienst contacteert (bv. telefonisch of per e-mail).<\/li>\n<\/ul>\n<p>Wij maken gebruik van cookies om onze website permanent te optimaliseren voor de gebruikers. Deze jongeren mogen zonder toestemming van de persoon die de ouderlijke verantwoordelijkheid draagt, geen persoonsgegevens aan ons doorgeven of een toestemmingsverklaring afgeven.<\/p>\n<p><strong>Welke persoonsgegevens verwerken wij, waarom en gebaseerd op welke rechtsgrond?<\/strong><\/p>\n<p>In onderstaande tabel leest u: (kolom 1) welke categorie\u00ebn van persoonsgegevens wij verwerken, (kolom 2) waarom wij dit doen (de \u2018doeleinden\u2019) en (kolom 3) op welke rechtsgrond de verwerking is gebaseerd.<\/p>\n<p>Elke verwerking van uw persoonsgegevens gebeurt immers voor \u00e9\u00e9n of meerdere specifieke doeleinden.<\/p>\n<p>Daarnaast is er steeds een aantoonbare rechtsgrond voor elke verwerking. Deze rechten zijn, onder andere, vastgelegd in artikelen 15-22 AVG.<\/p>\n<p>U beschikt over de volgende rechten:<\/p>\n<ul>\n<li>Het recht op inzage in de persoonsgegevens die wij van u verwerken\u00a0(art. 15 AVG):<\/li>\n<\/ul>\n<p>U heeft het recht om op ieder ogenblik van ons te vernemen of wij al dan niet uw persoonsgegevens verwerken. Als wij ze verwerken, dan heeft u het recht om deze persoonsgegevens in te zien en bijkomende informatie te ontvangen over:<\/p>\n<ol>\n<li>de verwerkingsdoeleinden;<\/li>\n<li>de betrokken categorie\u00ebn van persoonsgegevens;<\/li>\n<li>de ontvangers of categorie\u00ebn van ontvangers (met name ontvangers in derde landen);<\/li>\n<li>de bewaartermijn of, als dat niet mogelijk is, de criteria ter bepaling van die termijn;<\/li>\n<li>het bestaan van uw privacy-rechten;<\/li>\n<li>het recht om een klacht in te dienen bij de toezichthoudende autoriteit;<\/li>\n<li>de bron van de persoonsgegevens indien wij persoonsgegevens via een derde verkrijgen;<\/li>\n<li>het bestaan van geautomatiseerde besluitvorming.<\/li>\n<\/ol>\n<p>Als wij u geen toegang kunnen geven tot uw persoonsgegevens (bijvoorbeeld omwille van wettelijke verplichtingen), laten wij u weten waarom dat niet mogelijk is.<\/p>\n<p>Ook kan u een kosteloze kopie, in een begrijpelijke vorm, verkrijgen van de verwerkte persoonsgegevens. Let wel, wij kunnen een redelijke vergoeding vragen om onze administratieve kosten te dekken voor elke bijkomende kopie die u opvraagt.<\/p>\n<ul>\n<li>Het recht op vergetelheid of om ons te vragen om uw persoonsgegevens te wissen\u00a0(art. 17 AVG):<\/li>\n<\/ul>\n<p>U kan ons in bepaalde gevallen vragen om uw persoonsgegevens te wissen. In dit geval dient u er evenwel rekening mee te houden dat wij u geen service meer kunnen bieden indien u dat wenst. Houd er ook rekening mee dat uw recht op vergetelheid niet absoluut is. Wij hebben het recht om uw persoonsgegevens te blijven bewaren wanneer dat nodig is voor, onder meer, de uitvoering van de overeenkomst, de naleving van een wettelijke verplichting of het instellen, uitoefenen of onderbouwen van een rechtsvordering. We zullen u daarover nader informeren in ons antwoord op uw verzoek.<\/p>\n<ul>\n<li>Het recht op rectificatie en aanvulling\u00a0(art. 16 AVG):<\/li>\n<\/ul>\n<p>Wanneer uw persoonsgegevens onjuist, verouderd of onvolledig zijn, kan u ons vragen om deze onjuistheden of onvolledigheden te laten verbeteren.<\/p>\n<ul>\n<li>Het recht op dataportabiliteit of overdraagbaarheid van persoonsgegevens\u00a0(art. 20 AVG):<\/li>\n<\/ul>\n<p>Ook heeft u het recht om, onder bepaalde voorwaarden, de persoonsgegevens die u aan ons heeft verstrekt voor de uitvoering van de overeenkomst of waarvoor u toestemming heeft gegeven, door ons te laten overdragen aan\u00a0 een andere verwerkingsverantwoordelijke. Voor zover het technisch mogelijk is, bezorgen wij uw persoonsgegevens rechtstreeks aan de nieuwe verwerkingsverantwoordelijke.<\/p>\n<ul>\n<li>Het recht op beperking van de verwerking\u00a0(art. 18 AVG):<\/li>\n<\/ul>\n<p>Indien \u00e9\u00e9n van de volgende elementen van toepassing is, kan u ons verzoeken om de verwerking van uw persoonsgegevens te beperken:<\/p>\n<ol>\n<li>u betwist de juistheid van die persoonsgegevens (in dit geval wordt het gebruik ervan beperkt gedurende een periode die ons in staat stelt om de juistheid van de persoonsgegevens te controleren);<\/li>\n<li>de verwerking van uw persoonsgegevens is onrechtmatig;<\/li>\n<li>wij hebben uw persoonsgegevens niet meer nodig voor de oorspronkelijke verwerkingsdoeleinden, maar u heeft ze nodig voor de instelling, uitoefening of onderbouwing van een rechtsvordering;<\/li>\n<li>zolang er geen beslissing is genomen over de uitoefening van uw recht op bezwaar tegen de verwerking, kan u verzoeken om het gebruik van uw persoonsgegevens te beperken.<\/li>\n<\/ol>\n<ul>\n<li>Het recht van bezwaar\u00a0(art. 21 AVG):<\/li>\n<\/ul>\n<p>U kan op grond van uw bijzondere situatie, bezwaar maken tegen de verwerking van uw persoonsgegevens, indien deze verwerking kadert in ons gerechtvaardigd belang of in de vervulling van een taak van algemeen belang. Wij staken in dat geval de verwerking van uw persoonsgegevens, tenzij we dwingende en legitieme gronden voor de verwerking kunnen aantonen die zwaarder wegen dan die van u, of wanneer de verwerking van de persoonsgegevens verband houdt met het instellen, uitoefenen of onderbouwen van een rechtsvordering.<\/p>\n<ul>\n<li>Het recht om niet aan geautomatiseerde besluitvorming onderworpen te worden\u00a0(artikel 22 AVG):<\/li>\n<\/ul>\n<p>U heeft het recht om niet onderworpen te worden aan een\u00a0<u>volledig<\/u>\u00a0automatische beslissing die u aanzienlijk treft of juridische gevolgen heeft.<\/p>\n<p>In drie situaties kan u zich niet op dit recht beroepen:<\/p>\n<ol>\n<li>als een wet dit toelaat (bijvoorbeeld ter voorkoming van belastingfraude);<\/li>\n<li>als de besluitvorming berust op een uitdrukkelijke toestemming van de betrokkene; of<\/li>\n<li>als dit noodzakelijk is voor de totstandkoming, of de uitvoering van een overeenkomst (let wel, hierbij maken wij steeds geval per geval een afweging of er minder privacy intrusieve methoden bestaan om de overeenkomst te sluiten of uit te voeren).<\/li>\n<\/ol>\n<ul>\n<li>Het recht om uw toestemming in te trekken\u00a0(art. 7 AVG):<\/li>\n<\/ul>\n<p>Wanneer uw persoonsgegevens worden verwerkt op basis van uw toestemming, kan u deze toestemming te allen tijde weer intrekken op eenvoudig verzoek.<\/p>\n<p><strong>Uitoefenen van uw rechten<\/strong><\/p>\n<p>Om deze rechten uit te oefenen kan u ons per e-mail contacteren op het volgende e-mailadres: contact@kanziapple.com. Om uw identiteit te kunnen nagaan vragen wij u om een kopie van de voorzijde van uw identiteitskaart mee te sturen.<\/p>\n<p>U kan al deze rechten kosteloos uitoefenen, tenzij uw verzoek kennelijk ongegrond of buitensporig is (bijvoorbeeld vanwege het repetitieve karakter). In dat geval hebben wij het recht om u een redelijke vergoeding aan te rekenen of te weigeren om gevolg te geven aan je verzoek.<\/p>\n<p><strong>Doorgeven aan derden<\/strong><\/p>\n<p>Wij zullen uw persoonsgegevens uitsluitend doorgeven aan derden conform de wettelijke bepalingen, wanneer u daarvoor toestemming heeft verleend of wanneer dit nodig is voor onze dienstverlening (op basis van ons gerechtvaardigd belang). Verder geven wij geen persoonsgegevens door aan derden, tenzij wij hiertoe verplicht zijn op basis van dwingende wettelijke bepalingen (bv. doorgifte aan externe organen, zoals toezichthoudende of rechtshandhavingsinstanties).<\/p>\n<p><strong>Categorie\u00ebn van ontvangers<\/strong><\/p>\n<p>Binnen onze onderneming zien wij erop toe dat uw persoonsgegevens uitsluitend toegankelijk zijn voor personen die deze nodig hebben om te voldoen aan de contractuele en wettelijke verplichtingen.<\/p>\n<p>In bepaalde gevallen worden onze medewerkers bij het uitvoeren van hun taken ondersteund door externe dienstverleners. Met betrekking tot gegevensbescherming is met al deze dienstverleners een overeenkomst afgesloten om erop toe te zien dat zij uw persoonsgegevens veilig, respectvol en als een goede huisvader beheren.<\/p>\n<p><strong>Doorgiften aan derde landen<\/strong><\/p>\n<p>We geven uw persoonsgegevens uitsluitend door aan verwerkers of verwerkingsverantwoordelijken in derde landen, voor zover we hiertoe wettelijk gerechtigd zijn.<\/p>\n<p>Voor zover dergelijke doorgiften nodig zijn, nemen wij de nodige maatregelen om ervoor te zorgen dat uw persoonsgegevens in hoge mate worden beschermd en dat alle doorgiften van persoonsgegevens buiten de EER rechtmatig plaatsvinden. Indien er een doorgifte plaatsvindt naar een land buiten de EER, waarvoor de Europese Commissie niet heeft vastgesteld dat het land een passend niveau van bescherming biedt, is de doorgifte steeds onderworpen aan een overeenkomst die voldoet aan alle vereisten voor doorgiften aan derde landen, zoals de goedgekeurde standaardbepalingen inzake gegevensbescherming die zijn vastgesteld door de Europese Commissie. De door de Europese Commissie goedgekeurde standaardbepalingen kan u raadplegen via de volgende hyperlink:\u00a0<a href=\"https:\/\/ec.europa.eu\/info\/law\/law-topic\/data-protection\/data-transfers-outside-eu\/model-contracts-transfer-personal-data-third-countries_nl\">https:\/\/ec.europa.eu\/info\/law\/law-topic\/data-protection\/data-transfers-outside-eu\/model-contracts-transfer-personal-data-third-countries_nl<\/a>.<\/p>\n<p><strong>Beveiliging van uw persoonsgegevens<\/strong><\/p>\n<p>Wij hebben alle redelijke en passende technische en organisatorische beveiligingsmaatregelen getroffen om uw persoonsgegevens zo goed mogelijk te beschermen tegen toevallige dan wel opzettelijke manipulatie, verlies, vernietiging of toegang door onbevoegde personen. Zo bewaren wij uw persoonsgegevens steeds op een beveiligde plaats zodat derden geen toegang hebben tot uw persoonlijke gegevens.<\/p>\n<p><strong>Bewaren van uw persoonsgegevens<\/strong><\/p>\n<p>Wij bewaren uw persoonsgegevens zolang deze noodzakelijk zijn voor verwezenlijking van het beoogde doel. Houd er rekening mee dat tal van (wettelijke) bewaartermijnen ertoe leiden dat persoonsgegevens opgeslagen (moeten) blijven.
